Another victory today at the Magistrates Court in Shah Alam. Three (3) of our clients were accused of Extortion under s.383 and punishable under s.384 of the Penal Code, was acquitted and discharged by the learned Magistrate Tuan Mohamed Redza Azhar Rezali in Shah Alam today after a full trial. The offence was alleged to have been committed on 4 May,2019 at Kg.Baru, Sg.Buloh, Selangor. The learned Magistrate acquitted and discharged our clients at the close of the prosecution case without calling for their defence.
The learned Magistrate in his brief grounds of judgment concluded that the Prosecution has failed to make out a prima facie case against our clients. The learned Magistrate ruled that the Prosecution has failed to prove the first three of the five ingredients required for an offence of extortion allegedly committed by our clients in this case. Great news after almost three years of going in and out of the court room for our clients. Looks like a New Year present for them. I was assisted by Anis Salihah Abdul Malek.
