Another victory at the court of appeal. Our client, is the chief monk of a Buddhist temple in Taiping, Perak. The chief monk’s suit against 4 individuals for malicious prosecution and for abuse of court process was reinstated by the court of appeal comprising Ya Yaacob Md Sam, Ya Che Mohd Ruzima and Ya Mohd Nazlan.
- 18.9.2019: Four(4)individuals instituted committal proceedings against our client.
- 9.1.2020: The 4 individuals opted to withdraw the committal proceedings against our client on the date of hearing
- 8.8.2020: our client filed a claim against the 4 individuals whom had filed the committal proceedings as it is alleged to be with malicious intent.
Since the committal proceedings was terminated in our client’s favour, our client commenced a suit against the 4 individuals for malicious prosecution and abuse of court process in the high court of Taiping and sought compensation from the 4 individuals as our client, being the chief monk of a Buddhist temple, has suffered damage as a result of the committal proceedings. In the High Court, the 4 individuals successfully struck out our client’s suit under order 18 rule 19 of the rules of court, 2012. We appealed to the court of appeal and our appeal was allowed with costs of rm 10,000.00. our client’s suit is now reinstated to the high court for a full trial in the matter. A very happy ending
