Mr.Justice MUNIANDY KANNIAPPAN acquitted and discharged our client

Another victory at Kuala Lumpur High Court 2 Criminal Division.

Mr.Justice MUNIANDY KANNIAPPAN acquitted and discharged our client and also that of our learned friend Mr.Saminathan’s client of the charge of murder under S.302 of the Penal Code. The learned Judge acquitted and discharged our clients on the ground that the Prosecution had failed to prove a prima facie case against them and ordered them to be released forthwith without calling for their defence.
The learned Judge acquitted and discharged them on the ground, amongst others ,that the Prosecution failed to call a material close eye witness to the crime, and that is a LADY NASI LEMAK SELLER. The learned Judge also noted that there were two scenes of the crime depicted in the prosecution’s cas,e but failed to connect them to the facts and evidence of the case presented.
