Our client’s claim of RM57,384.35 against a Tyre Service company was upheld by the High Court today. Our client’s Mercedes Benz Brabus Model S350 skidded, swirled, went out of control and stalled by the roadside when one of the screw to the front left tyre came off resulting in severe damage to our client’s car. This was due to the negligence of the employee of the tyre shop for having fixed the tyre with wrong screws after changing the tyre. Our client sued the tyre shop and succeeded in the Sessions Court in Ipoh. Today, Mr.Justice Tuan Moses Susayan of the High Court in Ipoh affirmed the decision of the Sessions Court on our client’s claim for special damages for RM 57,384.35.
